Prospectors Supplies Pty Ltd Terms and Conditions

Account Customers

  1. Terms of Trade:
    • Our terms of trade are strictly 7 days from the date of invoice. It is important to adhere to our terms to ensure the efficient and viable operation of Prospectors Supplies Pty Ltd. Customers with overdue accounts risk delays in their orders.

Non-Account Customers

  1. Payment Methods:
    • Payment by credit card, cash, or direct deposit is required before goods are dispatched.

New Accounts

  1. Credit Account Applications:

Delivery

  1. Dispatch Time:
    • Wherever possible, goods will be dispatched within 24 hours after receiving your firm order. In most cases, if you order before 12:00 (12:00 PM) AEST, Prospectors Supplies Pty Ltd will dispatch the goods the same day.

Free Shipping Policy

  1. Eligibility:

    • Free shipping is available for orders with a total value of $200 or more.
    • The free shipping offer applies only to deliveries within Australia.

  2. Shipping Method:

    • Eligible orders will be shipped via standard Australia Post service.

  3. Exclusions:

    • Orders containing products exceeding 105cm in length once packed are not eligible for free shipping.
    • Orders that include Dormer products are excluded from the free shipping offer.

  4. Additional Charges:

    • Any delivery requirements or destinations outside the stipulated terms will incur shipping charges at the customer’s expense.

  5. Policy Changes:

    • Prospectors Supplies Pty Ltd reserves the right to modify or discontinue the free shipping policy at any time without prior notice.

  6. Miscellaneous:

    • This free shipping offer cannot be combined with any other promotional offers unless explicitly stated.
    • In the event of partial returns that bring the order value below $200, the cost of shipping may be deducted from the refund.
    • Free Shipping will be automatically calculated at check out for eligible orders.

Registered Post

  1. Weight/Size Limit:
    • The weight of any one box sent by registered post cannot exceed 20kgs or 105cm in Length.

Parcel Post Plus

  1. Available Sizes:
    • Available in 500g, 3kg, and 5kg satchels. Delivery time of 1-5 working days. Delivery time is not guaranteed.

Inspection of Delivered Goods

  1. Inspection Requirement:
    • Prospectors Supplies Pty Ltd requires buyers to inspect all goods upon delivery and notify us within 48 hours if the goods are not in accordance with your order. Failing this, the goods shall be deemed to have been delivered to and accepted by you.

Insurance

  1. Insurance Cover:
    • Insurance cover will be effected by Prospectors Supplies Pty Ltd for all goods dispatched by the nominated carrier. If you do not require insurance cover, please advise us in writing prior to dispatch.

Back Orders

  1. Stock Availability:
    • Prospectors Supplies Pty Ltd endeavors to maintain an adequate stock of all listed items. Occasionally, we are unable to supply from stock, and it becomes necessary to place these items on back order. When this happens, you will be kept informed of the progress, and the item(s) will be dispatched immediately upon receipt at our store.

Return of Goods

  1. Authorisation:
    • Goods that have been ordered and delivered require prior authorisation before return. Do not dispatch items for return without first contacting our office. You will be given a Goods Return Number.
    • Items must be returned in new condition and in original wrapping, packaging, etc. All freight charges on incorrectly ordered goods are the responsibility of the customer.
    • No returns after 30 days from the date of invoice.

Quotes

  1. Validity:
    • Unless otherwise indicated, quotes are valid for 30 days. Quotes are not an obligation to sell, and no contractual obligations will come from them until your order has been accepted in writing.

Passing of Property and Risk

  1. Transfer of Ownership:
    • Goods supplied by us to you become your property and risk immediately on delivery.

Supply

  1. Right to Suspend or Discontinue:
    • Prospectors Supplies Pty Ltd reserves the right to suspend or discontinue the supply of goods to you without prior notice. We also reserve the right to cancel any order made by the buyer without prior notice.

Shipping of Dangerous & Hazardous Goods

  1. Alteration of Shipping Charge:
    • Prospectors Supplies Pty Ltd reserves the right to alter the shipping charge on any item on an invoice if the items purchased are deemed to be Dangerous & Hazardous Goods. These items have to be shipped via alternate methods and incur additional costs.

Part Deliveries

  1. Right to Part Deliveries:
    • Prospectors Supplies Pty Ltd reserves the right to make part deliveries of your order, and each part delivery is considered a separate sale as per these terms and conditions. A part delivery of an order shall not invalidate the balance of an order.

Installation

  1. Supply Only Basis:
    • Our goods are supplied on a supply-only basis. Any installation fee is at your expense.

Manufacturer’s Changes and Descriptive Details

  1. Approximations:
    • All descriptive details are provided as approximations and are subject to change without notice. Manufacturer’s specifications are subject to change without notice.
    • Prospectors Supplies Pty Ltd is not responsible for any loss or damage incurred due to incorrect descriptions of goods.

Currency

  1. Exchange Rate Fluctuations:
    • Any adverse variation in the price due to exchange rate fluctuation will be to your account.

Contingencies

  1. Additional Charges:
    • Prospectors Supplies Pty Ltd cannot be held responsible for any charge, sales tax, levy, or other expenditure which is not applicable at the date of quotation/invoice but is later charged to you.

Charges Beyond Point of Delivery

  1. Customer Responsibility:
    • You are responsible for all charges incurred after the point of delivery.

Force Majeure

  1. Situations Beyond Control:
    • If our ability to meet our obligations to you is impeded by situations beyond our reasonable control (such as, but not limited to, natural disaster, raw material shortage, strike, industrial action, breakdown of transport or plant, etc.), Prospectors Supplies Pty Ltd can, at our discretion, inform you of any holdups. We cannot be held accountable for delays that occur because of reasons beyond our control.

Default

  1. Right to Stop Supply:
    • If any of these terms are not met, Prospectors Supplies Pty Ltd reserves the right to stop supply. We are not responsible for any loss or damage that may occur because of this.

Order Cancellation

  1. Cancellation Policy:
    • Unless otherwise agreed in writing, you cannot cancel an order that has been accepted by us. If a right of cancellation is expressly reserved by you, this must be exercised by notice in writing no later than 7 days prior to the estimated date of shipment. Unless otherwise agreed, on cancellation prior to shipment, any deposit paid by you shall be forfeited.

Warranty

  1. Manufacturer’s Warranty:
    • Prospectors Supplies Pty Ltd makes no exception to the extent that the goods supplied are covered by the manufacturer’s warranty, and we will pass on to you the full benefit of the manufacturer’s warranty. If you find any defect in the goods supplied by Prospectors Supplies Pty Ltd, you must notify us immediately (within 7 days) in writing. You cannot carry out any repair work to allegedly defective goods without first obtaining written consent from us.

Changes to the Conditions

  1. Right to Amend:
    • Prospectors Supplies Pty Ltd reserves the right to change these terms and conditions at any time without notice.

Governing Law

  1. Applicable Law:
    • These terms and conditions and all contracts that include them are governed by the laws of the State of New South Wales, Australia.
